These Terms of Service ("Terms") govern your access to and use of Tracqfit, a service operated by Fitaraise, a sole proprietorship based in India ("Fitaraise", "we", "us", "our"). By creating an account or purchasing a program, you agree to these Terms.
1. Acceptance of terms
By accessing or using Tracqfit, you confirm that you are at least 18 years old and legally able to enter into a binding contract. If you do not agree with any part of these Terms, you must not use the service.
2. What Tracqfit is (and isn't)
Tracqfit provides personalized workout and diet programs designed for general fitness, body composition, and health goals. Tracqfit is a wellness and education product. It is not a medical service, not a diagnostic tool, and not a substitute for professional medical advice.
3. Medical disclaimer
Important. Consult a qualified physician before starting any Tracqfit program, especially if you have (or suspect you have) a medical condition, are pregnant or nursing, are under 18, take prescription medication, or have ever experienced a heart, joint, or metabolic issue. Tracqfit and its content are not a substitute for medical advice, diagnosis, or treatment. If you experience pain, dizziness, shortness of breath, or any unusual symptom during a workout, stop immediately and seek medical attention. You exercise and follow nutrition plans at your own risk.
4. Account responsibilities
You are responsible for keeping your login credentials confidential, for the accuracy of the information you provide (including body stats, allergies, and health history), and for all activity on your account. Notify us at once if you suspect unauthorized access.
5. Intellectual property
All programs, plans, videos, written content, branding (including the "Tracqfit" and "Fitaraise" names and marks), and software on Tracqfit are owned by Fitaraise or licensed to us, and are protected by Indian and international intellectual property laws. We grant you a personal, non-transferable, non-exclusive licence to use the content for your own fitness goals. You may not resell, redistribute, or republish any part of the service.
6. Payment and refunds
Programs are sold as one-time purchases. There is no recurring subscription. Each program purchase grants you access for 365 days from the date of purchase. Payments are processed through a PCI-DSS compliant payment processor. Refund eligibility, windows, and process are described in our Refund & Cancellation Policy.
7. Limitation of liability
To the maximum extent permitted by law, Fitaraise will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the service. Our total aggregate liability for any claim arising out of these Terms will not exceed the amount you paid us in the 12 months preceding the event giving rise to the claim.
8. Termination
We may suspend or terminate your access if you breach these Terms or misuse the service. You may delete your account at any time by contacting support@tracqfit.com.
9. Governing law and jurisdiction
These Terms are governed by the laws of India. The courts of Bangalore, Karnataka have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the service.
